Attendee Policy

These are the terms and conditions governing your participation in the Xylem Reach 2024 Conference. By registering for the Event you agree to these terms and to the terms of Xylem’s Privacy Policy. If you are registering on behalf of another individual, it is your responsibility to ensure the person participating is aware of these terms and accepts them. By completing the registration on behalf of another individual you are warranting that you have made the participant aware of these terms and the terms of Xylem’s Privacy Policy and that they have accepted these terms.

Registration

You must provide accurate registration information and, where such information changes over time, update such information (to the extent possible: online) without undue delay. We will maintain your registration information in accordance with our Privacy Policy.

Xylem reserves the right to deny registration to any participant in its sole discretion, in particular if the participant engages in any prohibited conduct, violates these terms, or violates any applicable laws in the access to or use of the Xylem website.

By participating in the Event, you acknowledge and agree to grant Xylem the right at the Event to record, film, live stream, photograph, or capture your likeness in any media now available or hereafter developed and to distribute, broadcast, use, or otherwise globally to disseminate, in perpetuity, such media without any further approval from you or any payment to you. This grant to Event includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to use or disseminate the media.

Prohibited Conduct

Misuse of Access Data. Upon registration you will be provided with registration and access information (“Access Data”). You shall ensure that Access Data is not accessible by third parties and is liable for all transactions and other activities carried out under its Access Data. At the end of each online session, you shall log-off from the password-protected websites. If and to the extent you becomes aware that third parties are misusing its Access Data, you shall notify Xylem thereof without undue delay in writing, or, as the case may be, by e-mail. After receipt of this notice, Xylem will endeavor to deny access under such Access Data. Access by you will only be possible again upon your application to Xylem or upon new registration.

Disruptive Conduct. Xylem reserves the right to remove you from the Event if Xylem, in its sole discretion, determines that your participation or behavior create a disruption or hinder the Event or the enjoyment of the Event content by other attendees.

Recording, Live Streaming, and Videotaping. You may not record or broadcast audio or video of any portion of the Event.

Unethical/Non-Compliant Business Practices. We reserve the right to deny participation to anyone who engages in or is reputed to engage in unethical or non-compliant business practices.

Intellectual Property

All intellectual property rights in and to the Event, the Event content, and all materials distributed at or in connection with the Event are owned by Xylem, or the Event sponsors or speakers presenting at the Event. Xylem grants you permission to view and download material provided during the Event provided that (a) all copyright and proprietary notices are retained, (b) the materials are not publicly displayed, publicly distributed, or modified in any way and that no graphics are used separately from its accompanying text, and (c) any use of the material is for informational and non-commercial use only. You may not use record, distribute, or reproduce or allow anyone to record, distribute, or reproduce any Event content or material without the prior written permission of Xylem.

Cancellation

Xylem shall have the right to terminate the Event without liability and shall be relieved of its obligations to participant.

International Users, Choice of Law and Jurisdiction

The Event shall be deemed to be provided in the state of New York in the United States of America and you agree that the law governing these terms shall be the laws of the state of New York without regard to any principles of conflicts of law. You further agree that any disputes arising under these terms or from your attendance at the Event shall be submitted exclusively to the courts in the state of New York and that you will not assert jurisdiction in any other court or tribunal anywhere in the world.

Disclaimers

All materials on, distributed through or accessible from the Event is provided “as is” and “as available,” without warranty of any kind, expressed or implied including but not limited to the implied warranties of merchantability, fitness for particular purpose, or non-infringement. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.

Xylem does not warrant the accuracy or completeness of the materials, including but not limited to the reliability of any advice or statement displayed or distributed through the Event and your reliance on any such materials, advice, statement or information shall be at your sole risk.

Xylem shall not be liable for any damages to, including any damages from viruses that may infect your computer equipment or other property by virtue of your access to the Event or your downloading of any materials therefrom.

Limitation of Damages

In no event shall Xylem be liable for any direct, special, indirect, consequential, punitive or other damages of any kind whatsoever resulting from any cause whatsoever, including but not limited to loss of use, loss of profits, or loss of data whether in an action under the theories of contract, negligence, or strict liability or otherwise, arising out of or in any way connected with the Event or any materials, information or documents on or accessed through the Event.

Information Provided By You

Do not send any confidential or proprietary information to Xylem via the Event. You agree that any information you so send will not be considered confidential or proprietary and you grant Xylem an unrestricted, irrevocable, worldwide, royalty-free license to use, reproduce and distribute any such information.
